By using the www.asicc-med.com site (hereinafter referred to as "the Site"), you agree to follow the terms and conditions outlined in this document. These Terms and Conditions apply to all users of the Site and your use of ASICC-MED’s products, software, services and Site (hereinafter referred to as "the Services"). These Terms and Conditions describe the conditions under which ASICC-MED offers access to the Site. If you do not accept these Terms and Conditions, you are not authorized to use the Site or Services provided by ASICC-MED.
ASICC-MED may change these Terms and Conditions at any time, without prior notice to you, by uploading a new version on the Site. These Terms and Conditions were last updated October 17, 2009.
Terms of Use
The Site is intended for people who are of legal age to enter into a contractual agreement with ASICC-MED. These Terms and Conditions will remain valid until terminated by either you or ASICC-MED, as set out in these Terms and Conditions. In the event that your behaviour does not adhere to these Terms and Conditions, ASICC-MED retains the right to disable your account and prevent you from accessing the Services provided on the Site.
Service Description
ASICC-MED created the Site to provide helpful information to individuals, corporations, pharmaceutical companies, nurses, health institutions and all ASICC-MED employees. In addition, the Site also include Services that allow ASICC-MED employees and ASICC-MED clients to enter service or product requests as well as work schedule availability. By accepting these Terms and Conditions, you acknowledge that the Services offered by the Site may change from time to time and that some features or Services may be added, permanently or temporarily become unavailable at ASICC-MED's sole discretion, without prior notice to you.
Registration
ASICC-MED offers the opportunity for nurses and other ASICC-MED employees to use an online account where they can enter their work availability, contact information and holiday requests. The registration process is free of charge and the personal information provided to ASICC-MED is regulated by ASICC-MED’s Privacy Policy.
After users enter their personal information and select a username and password, ASICC-MED will contact the users by email or phone in order to activate their account.
By registering and/or using the Services offered by the Site, you agree to the following:
- You are solely responsible to ensure that the personal information listed on the Site and used in communication with ASICC-MED is maintained accurate, current and complete at all times;
- You are solely responsible to maintain the security of your username and password used to access the Services;
- You can only have one account at any time and you cannot sell or transfer that account to third-parties; and
- You are and will be fully and solely responsible for any and all use of your account and for any actions that take place using your account.
Purchasing Products or Services
Users can purchase products and/or services from the ASICC-MED website. Once users are ready to check out, they will automatically be directed to the PayPal site to process their payment. PayPal is a widely recognized method of payment for online purchases and entitles users to pay using their PayPal account or their Visa, American Express or MasterCard. Users will receive a copy of the invoice by email. All products and services sold on the Site are subject to all applicable taxes. By accepting these Terms and Conditions, you agree to only receive invoices in electronic format.
Fraudulent Use of Site and Services
Without excluding other remedies, ASICC-MED reserves the right to give you a warning, to temporarily or permanently suspend your registration, to terminate your registration and to cease the provision of Services in any of the following cases:
- If you are engaged in fraudulent activities in connection with the Site following a conviction, transaction or police investigation;
- If you violate all or any sections of these Terms and Conditions or Privacy Policy; or
- If we believe that your actions are likely to incur responsibility from you, us or any other users.
Limitation on Liability
The Site may be temporarily unavailable from time to time for server maintenance, database update or other reasons. ASICC-MED assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, user communications. Under no circumstances will ASICC-MED be responsible for any loss or damage, including, but not limited to personal injury or death, resulting from use of our Services.
ASICC-MED cannot guarantee that the operation of its Site or Services will be uninterrupted, safe and free from any error. ASICC-MED cannot be held responsible for any breach of its obligations under these Terms and Conditions when caused by circumstances beyond our control such as all acts of government, any strike or lockout, natural disasters, acts of war, violations of public order, epidemics, fires, floods, as well as all external technical, Internet or electrical problems to third-parties that provide services to our Site.
By using and viewing this site, you acknowledge that ASICC-MED specifically disclaims any contractual, tort, strict or any other type of liability for any direct, indirect, incidental, consequential, punitive or any other type of damage associated with the Site, including but not limited to, any virus that may infect your computer.
All efforts are made to ensure such consequences do not occur but you are held solely responsible for any damage related to downloading material obtained from the Site or from sites linked to the Site. ASICC-MED will not be held liable for the unavailability or failure of Site functions except to the extent required by applicable laws.
Similarly, the Site will contain links to other sites and other sites may link to this site. These links are added for pure convenience and ASICC-MED is not responsible for the accuracy, reliability or completeness of the content from these others sites. Accessing these sites is done at your own risk.
Limitation on Usage
You cannot copy, modify, distribute, license, disseminate, display, reproduce, transfer, sell or offer to sell any material, information, product or service viewed or obtained from this Site without express permission from ASICC-MED.
Resolution of Disputes
These Terms and Conditions shall be governed and construed in accordance with the laws of Canada and the province of Québec. The users consent to the exclusive jurisdiction of the provincial courts of Québec and Canadian federal courts for any dispute arising out of these Terms and Conditions where the disputes cannot be reconciled through serious and genuine attempts through third party mediation. In the event that one or more terms in the Terms and Conditions are considered illegal, unenforceable or inapplicable by a court decision, the remaining provisions of the Terms and Conditions will remain in force.
